Terms of Service
Version 2.0. Effective 13 August 2026. These terms replace the Terms of Service dated 9 November 2025. If you subscribed before this version took effect, section 21 tells you where you stand.
The short version
This summary is here so you can see what you are agreeing to in about a minute. It is a summary, not the agreement. The numbered sections below are the agreement, and they are written to be read.
- My Portfolio adds up figures you type in yourself. It does not connect to your bank, it does not ask for a bank login, it holds no money, and it moves no money.
- It is not financial advice. We do not tell you what to buy, what to sell, what to borrow, or whether you are on track. We are not licensed to, and we do not want to be.
- Subscriptions are real and they are sold now. They renew automatically until you cancel.
- You cancel with Apple or Google, not with us. We cannot cancel a store subscription on your behalf.
- Deleting your account does not cancel your subscription. Cancel first, then delete.
- If you share a portfolio with someone, they see and can change everything in it. There is no partial view.
- Your rights under the Australian Consumer Law apply and cannot be signed away. Nothing here takes them from you.
- The figures you enter are yours. We do not sell them, and we do not use them to advertise to you.
1. Who you are agreeing with
My Portfolio is operated by Jesse Thomson, trading as Emerald Websites, ABN 68 410 407 820, of Emerald, Queensland, Australia.
That is a sole trader. One person, not a company. There is no "Emerald Websites Pty Ltd", there are no affiliates, and there is no group of companies standing behind this. When these terms say "we", "us" or "our", they mean that one person. When they say "you", they mean the person using the app.

You did not get to negotiate these terms, so the law protects you
We wrote them and you do not get to change them. Australian law gives you protection because of that: if a term in a standard form consumer contract is unfair, it does not bind you. We have tried to write terms that are fair and readable, and this page is public, so you can read it before you buy rather than afterwards. If you think a term here is unfair, tell us and we will look at it properly.
2. What My Portfolio is
My Portfolio is an app for a household to see its own money in one place. You type in what you own, what you owe, what comes in and what goes out. The app adds it up and shows you:
- what you own, what you owe, and the difference between them;
- what comes in and what goes out over a week, a fortnight, a month or a year;
- how much of your spending is already covered by income that pays you whether or not you work, and how much is not covered yet;
- on a loan, how much of a repayment is interest and how much is principal. Principal is not really spending. It moves from one side of your ledger to the other.
When you leave a figure blank, the app leaves it out of the total and tells you it has done so. It does not guess at a figure you have not given it, and it does not treat a blank as zero.
You can use My Portfolio in a web browser at app.myportfolioapp.com.au. There are also iPhone and Android versions on the App Store and Google Play.
3. What My Portfolio is not, and this part matters
My Portfolio does not give financial advice. Not general advice, not personal advice, not a recommendation about any financial product. We do not hold an Australian Financial Services Licence and we are not authorised to provide financial services.
Specifically:
- We do not connect to your bank and we do not ask for a bank login. There is no feed to connect and nowhere in the app to give us one. Every figure in the app is a figure a person in your household typed in. This is deliberate, and it is one of the reasons the app holds so little.
- We hold no money and we move no money. We are not a bank, a broker, a lender, a fund, a payment service or a custodian. Nothing in the app buys, sells, transfers or invests anything.
- We do not tell you what to do. The app does not recommend a product, a share, a property, a fund, a super fund, an insurer or a loan. It does not rate anything, score you, or tell you whether you are on track. It shows you your own arithmetic.
- We are not part of any loan or credit application. We do not suggest lenders or credit products, we do not help you apply for credit, and nothing in the app is credit assistance. If the app helps you produce a summary of your own expenses to hand to a broker, an accountant or a lender, that is your figures in a tidier format. We do not send it anywhere, we do not check it, and we are not a party to whatever you apply for.
Any calculator or projection in the app works the same way as everything else. It does arithmetic on figures you entered. The assumptions are on the screen and you can change them. It is not a forecast of what any investment will return, it is not a promise about your future, and it is not a recommendation. Two households entering the same figures see the same result, because the calculator knows nothing about either of them.
None of this means the numbers do not matter. They matter a great deal, which is why the app is careful with them. It means the decisions are yours, and if you want advice about them, get it from someone licensed to give it.
4. Your account
You need an account to use My Portfolio. You can sign in with:
- an email address and a password;
- Sign in with Apple;
- Google Sign-In.
When you sign up with an email address and a password, the app sends you a verification email. You can use My Portfolio before you verify, but verifying is what makes a password reset trustworthy, so it is worth doing. If it does not arrive, check your junk folder and then tell us.
You must be at least 16 to have an account. Keep your password to yourself, and tell us straight away at info@emeraldwebsites.com.au if you think someone else has got into your account. We never see your password. Sign-in is handled by Firebase Authentication, and what we hold is an account record, not a password.
5. Sharing a portfolio with someone else
A household has one set of bills and usually more than one phone. So a portfolio can be shared. If you own a portfolio you can invite someone else to it, and from their own login they will see and be able to change everything in it.
Before you send an invitation, be clear about what it does:
- An invited member sees the whole portfolio. Every asset, every debt, every income line, every expense, and every name and note attached to them. There is no partial view and no read-only mode.
- An invited member can change and delete things. Including things you entered.
- The invitation link is the key. Anyone who has the link and signs in can join, whether or not they are the person you addressed it to. Treat it like a password: send it to the person you mean, and do not post it anywhere. An invitation expires after 14 days, and you can revoke it before it is used.
- Opening the link shows the portfolio's name, and your name or your email address. That is so the person can see what they are joining and who asked them. It happens before they join anything.
- Members can see each other. The name and email address on each member's account is visible to the other members of that portfolio.
- Only the owner can invite or remove people. Anyone can remove themselves. The owner cannot be removed, not even by themselves. If you own a portfolio and want out of it, delete the portfolio, or delete your account: if other people are still in it, ownership passes to whoever has been a member longest and the portfolio carries on without you.
If you invite someone, you are responsible for that decision. We cannot un-see data for them, and we cannot arbitrate between two people who share a portfolio and later disagree about it. If a relationship changes, remove the member. That stops their access from that moment, although their phone may keep the copy it had already downloaded until they delete the app. Section 18 explains what happens to the figures.
6. What a subscription costs and what it gets you
My Portfolio has paid plans, and they are on sale now. As at 13 August 2026 they are:
- Monthly — [MONTHLY PRICE] per month;
- Yearly — [YEARLY PRICE] per year;
- Lifetime — [LIFETIME PRICE], paid once. See section 7.
All prices are in Australian dollars. The subscribe screen in the app tells you, before you pay, which plan you are buying, what it costs, how long the period is, when it renews, and how to cancel. The App Store or Google Play then shows you the exact amount you will be charged before you confirm. That store screen is the final word on what you pay.
What the paid plans unlock is listed on the subscribe screen in the app. If you do not subscribe, you can still use the free features, and the figures you have already entered stay in your account and stay visible to you.
A subscription is attached to the App Store or Google Play account that bought it, not to your My Portfolio login and not to a particular phone. If you reinstall the app or sign in on another device, use "Restore purchases" on the subscribe screen.
7. The lifetime plan
The lifetime plan is a one-off purchase, not a subscription. Nothing renews and you are not charged again.
"Lifetime" means for as long as My Portfolio is available to the public. It does not mean your lifetime, and we are not going to pretend otherwise. We are one person, so here is what we can and cannot honestly say:
- We intend to keep My Portfolio running, and we have no plan to stop.
- We cannot promise it runs forever. Nobody honestly can.
- If we stop offering My Portfolio to the public within [3] years of your lifetime purchase, we will email you at least [90] days beforehand, and refund part of what you paid.
- The refund is worked out by how much of those [3] years is left. If half of it is left, you get half of what you paid back.
- If the app is sold or transferred to someone else, your lifetime access goes with it on these same terms. If the buyer will not honour it, the refund above applies.
- Lifetime access covers My Portfolio. It does not cover a different product we might build later.
None of this limits your rights under the Australian Consumer Law, which are in section 13.
8. Free trials and automatic renewal
Some plans are offered with a free trial. The length of the trial is shown on the subscribe screen, and again on the store's confirmation screen, before you agree to anything.
Here is exactly what happens, so nothing is a surprise:
- A free trial turns into a paid subscription automatically at the end of the trial, at the price shown when you signed up, unless you cancel first.
- A paid subscription renews automatically at the end of each period, and keeps renewing until you cancel.
- The store takes the next payment in the 24 hours before your current period ends. So cancel more than 24 hours out, or you will be charged for the next period.
- Renewals are charged at the price current at the time. If we change the price, section 11 applies.
- If you cancel after a renewal has been charged, that charge stands and the next one does not happen. You can still ask Apple or Google for a refund, and your Australian Consumer Law rights are unaffected. See sections 10 and 13.
- You can only have one trial per store account. Apple and Google enforce that, not us.
Apple and Google send their own receipts and reminders, and you can see every subscription you have, with its next billing date, in your store account at any time.
9. How to cancel
You cancel with the store you bought from. We cannot do it for you, and emailing us will not stop a charge. This is not us passing the buck. A store subscription can only be cancelled inside the store account that owns it.
- iPhone or iPad: Settings, then your name, then Subscriptions. Or go to apps.apple.com/account/subscriptions.
- Android: open the Play Store, tap your profile icon, then Payments and subscriptions, then Subscriptions.
There is no notice period, no cancellation fee, and you do not have to tell us why. Cancelling stops future renewals. You keep the paid features until the end of the period you have already paid for.
If you cannot find the setting, email us at info@emeraldwebsites.com.au and we will walk you through it.
10. Refunds
Apple and Google take the payment and each runs its own refund process:
- App Store: reportaproblem.apple.com.
- Google Play: play.google.com/store/account, or the Google Play refund form.
Those processes are in addition to your rights under the Australian Consumer Law. They do not replace them and they do not limit them. A store's refund policy is that store's policy, not a description of your legal rights.
We are the supplier of My Portfolio. If a store declines a refund and you believe you are entitled to a remedy under the consumer guarantees in section 13, write to us at info@emeraldwebsites.com.au with what happened. We will assess it on its merits and tell you what we have decided and why.
We do not say that all sales are final, because that is not the law here.
11. If we change the price
We may change the price of a plan. If we do:
- we will tell you by email at least 30 days beforehand;
- the new price applies only from your next renewal, never mid-period;
- you can cancel before it takes effect, and if you do you are not charged the new price;
- Apple and Google also run their own price change processes, and for an increase those may ask you to agree before it applies. If a store's process gives you more protection than this section, the store's process applies as well.
We will not treat your silence as your agreement to a price rise. If you do nothing and the store requires your consent, the subscription simply does not renew at the new price.
12. If we change the app
We will keep improving My Portfolio, and that means it will change. Most changes are additions and fixes, and we do not need to warn you about those.
If we make a change that materially reduces the functionality you subscribed for, you can cancel and we will refund the unused part of anything you have prepaid, worked out pro-rata. We will tell you about a change like that by email before it happens.
13. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these terms excludes, restricts or modifies those guarantees, or any other right or remedy you have under a law that cannot be contracted out of. If any part of this document conflicts with them, the law wins and that part does not apply to you.
In plain terms: what you buy has to be of acceptable quality, it has to match how we have described it, and it has to be supplied with due care and skill. If it is not, you may be entitled to a repair, a replacement, a refund, or compensation for reasonably foreseeable loss, depending on how serious the problem is. Those rights are yours whatever a store's refund policy says, and whatever the rest of this document says.
The arithmetic is ours. Adding up your figures correctly is the whole job of this app. If it adds them up wrongly, that is our problem and the consumer guarantees apply to it. The old version of these terms said we did not guarantee that calculations would be accurate or reliable. That sentence is gone, and it is not coming back.
What we do not do
This is not a disclaimer of the guarantees above, which cannot be disclaimed. It is a plain description of how the app works, so you know what you are buying:
- The figures come from you. We do not connect to your bank, so we have no way of knowing whether a number you typed is the right one. If you enter last year's loan balance, the app will faithfully use last year's loan balance.
- We do not value anything for you. A property value, a share price or a super balance in the app is the figure you entered, not a valuation we have obtained or checked.
- The decisions are yours. We do not know your circumstances, we are not advising you, and we are not part of what you decide to do.
- Software has faults, and phones and networks fail. If something looks wrong, please tell us at info@emeraldwebsites.com.au. Telling us costs you nothing and takes nothing away from your rights above.
14. Where our liability is limited
Section 13 gives you rights we cannot take away, and this section does not touch them. For everything else, and only as far as the law allows:
- we are not liable for loss that flows from a figure you or another member of your portfolio entered incorrectly;
- we are not liable for loss caused by something genuinely outside our control, such as an outage at Apple, Google or our hosting provider, or your own device or internet connection failing;
- we are not liable for loss that was not reasonably foreseeable as a result of the problem; and
- our liability is reduced to the extent that you caused or contributed to the loss.
We do not exclude liability for death or personal injury, for fraud, or for anything else the law does not permit us to exclude.
15. Your data and your privacy
The figures you enter are yours. We claim no ownership of them and no rights over them beyond what we need to run the app for you: storing them, showing them back to you, syncing them between your devices and the other members of your portfolio, and backing them up.
We do not sell your data. We do not use it to advertise to you. We do not use it to train any model. We do not disclose it to anyone except the infrastructure providers who host it for us, and every one of those is named in our Privacy Policy.
Our Privacy Policy, at myportfolioapp.com.au/privacy-policy/, explains what we collect, where it is held, who else sees it and how long it is kept. It forms part of these terms, and where the two documents describe the same thing, they say the same thing.
16. Using the app properly
Please do not:
- use My Portfolio to break the law, or to defraud anyone;
- try to get into another person's account, another household's portfolio, or our systems;
- test our security without our written permission;
- upload or send anything designed to damage the app, our systems, or another user;
- copy, resell, rent out, sublicense or reverse engineer the app, unless the law says you can anyway;
- use automated tools to scrape the app or hammer our systems in a way that degrades it for other people.
That list is what we mean. There is no catch-all about "misusing the app in any way", because a rule nobody can predict is not a rule.
17. Suspending or ending your access
We would much rather sort a problem out than end someone's account. If we think you have done one of the things in section 16:
- we will tell you in writing what the problem is;
- if it is something that can be fixed, we will give you at least 14 days to fix it before we do anything;
- we will only act immediately where the conduct is unlawful, or where it is a genuine and immediate threat to the security of the app or to other people's data, and we will explain why as soon as we reasonably can;
- if we end your access for any reason other than a serious breach by you, we will refund the unused part of anything you have prepaid; and
- if you ask us before we act, we will send you a copy of everything we hold about you, so you do not lose your own figures.
We may also stop offering My Portfolio altogether. If we do, we will give you reasonable notice, and section 7 applies if you bought the lifetime plan.
18. Cancelling and deleting your account
Cancel first, then delete. In that order.
Deleting your account does not cancel your subscription and does not stop Apple or Google charging you. Those are store subscriptions, held in your store account, and only you can cancel them there. If you delete your account while a subscription is running, the store keeps billing you, and once the account is gone we cannot see it, find it or stop it.
So: cancel with Apple or Google first, using section 9. Then delete.
What deleting actually removes
You delete your account from inside the app. When you confirm, your sign-in record is deleted and an automatic process starts within moments. It removes:
- everything held under the older version of the app's layout: the assets, liabilities, income, expenses and portfolio-level figures stored against your account there. An account created on the current version has no such record;
- any portfolio you own that nobody else is in, and everything in it: every asset, liability, income line and expense, including property addresses, institution names and anything you typed into a name or a note;
- every invitation you have sent, whether or not it was accepted, and every invitation sent to the email address on your account.
Afterwards, the process re-reads the records held under that older layout and records a fault if anything survived. If you can still see anything of yours after a deletion, tell us. That is a fault, and we will finish it by hand.
What deleting does not remove, and why
- A portfolio you share with someone else. If you own a portfolio that other people are still in, deleting your account does not delete it. You are removed from it, and your name and email go with you, but the portfolio and its figures stay, and ownership passes to the member who has been in it longest. Deleting a whole household's records because one person left would be the worse outcome. If you want the portfolio gone, delete the portfolio itself before you delete your account.
- A portfolio you joined but do not own. You are removed from it and your name and email are removed from its member list. The figures stay with the owner, because they are the owner's record.
- Backups and system logs. Our hosting provider keeps routine backups and operational logs. Records can survive in those for a period after deletion, before they are overwritten in the normal course. We do not use them for anything, and we do not restore deleted accounts from them.
- Purchase records held by Apple, Google Play and our billing provider. Those are their records of a payment you made to them. They are not ours to delete.
- Our own sales records. Australian tax law requires us to keep records of sales, and we keep those for as long as the law requires.
Deletion is permanent. We cannot undo it, and we have no copy to give you afterwards.
19. What we own and what you own
You own the figures and notes you put into My Portfolio.
We own the app itself: the name, the logo, the design, the code and the content we wrote. You can use My Portfolio for your own household for as long as these terms apply to you. You cannot pass that right to anyone else, resell it, or run a business on it.
My Portfolio is our own work. It is not affiliated with, endorsed by or licensed by any other author, publisher, framework or brand.
20. If we change these terms
We will need to update these terms from time to time, and here is how that works:
- For any change that materially affects you, we will give you at least 30 days' notice by email, and we will say plainly what is changing.
- The change takes effect at the start of your next billing period, or 30 days after the notice if you do not have a subscription.
- You can cancel before it takes effect. If you do, we will refund the unused part of anything you have prepaid.
- We will not treat you carrying on using the app as you agreeing to a change that materially and adversely affects you. Where we need your agreement, we will ask for it.
- Small changes that do not affect your rights, such as fixing a typo, making a sentence clearer or updating our contact details, take effect when we publish them.
Every version carries a version number and an effective date, and we keep the previous versions so you can see what changed.
21. If you subscribed before this version
If you subscribed before 13 August 2026, these terms apply to you from your next renewal, not before. If you would rather they did not, email us at info@emeraldwebsites.com.au before then and we will sort it out with you individually.
You are not worse off under these terms than you were under the ones they replace. This version adds things the earlier document did not have at all: how to cancel, how renewals work, what happens if we change the price, and what a refund looks like.
22. If something goes wrong between us
Email info@emeraldwebsites.com.au and tell us what happened. We will reply within 5 business days and give you a full answer within 30 days. If it is going to take longer than that, we will tell you why and when to expect an answer.
If we cannot sort it out, you can take it further. You can contact the Australian Competition and Consumer Commission, or the fair trading or consumer affairs office in your own state or territory, and you can take the matter to a court or a consumer tribunal. Nothing in these terms stops you doing any of that, and you do not have to come to us first.
23. Which laws apply, and where you can sue
These terms are governed by the law of Queensland, Australia.
You can bring proceedings about these terms in the courts or the consumer tribunal of the state or territory where you live. You do not have to travel to Queensland to enforce your rights, and nothing in these terms requires it. We agree to be sued in Queensland or where you live, whichever suits you.
My Portfolio is made for people in Australia. If you use it from somewhere else, the laws of that place may also apply to you, and you are responsible for that.
24. Odds and ends
- If a court finds part of these terms unenforceable or unfair, that part stops applying and the rest carries on.
- If we do not enforce something straight away, we have not given up the right to enforce it later.
- You cannot transfer your account or your rights under these terms to someone else. We can transfer our side if we sell or transfer the app, but only on terms that leave you no worse off, and section 7 protects lifetime purchasers.
- These terms, together with the Privacy Policy, are the whole agreement between us about My Portfolio. Nothing in this clause limits your rights about anything we have actually told you elsewhere.
